Yet another day passes...

Well, its another day, anytime am, on every night.

I'm sitting here thinking "why the hell haven't I gotten any songs finished lately?" Its not that I don't have the time. Plain and simple, its that I lack the motivation.

Anyway, this is a call to all my friends I've acquired online and in the real world over the years. In the next month, if you see me, make sure to ask me why I'm not playing music, then yell and swear alot if I don't immediately start.

Why is it that the one hobby I supposedly love most in life, is the one thing I do least? Answer that correctly and I'll send you a case of Smarties candy.

Company sues Clear Channel to keep domain name

Radio giant contends RadioAid is using Web site to divert consumers

A small Austin Internet company filed suit against Clear Channel Communications on Tuesday over a Web site domain name that criticizes the San Antonio-based radio giant.

RadioAid.com, an online promoter of unsigned and independent musical artists, purchased ClearChannelSucks.net in January 2002 after learning that Clear Channel already owned ClearChannelSucks.com.

RadioAid's founders used the domain, which redirects browsers to the company's home page, to promote RadioAid and to protest the established music industry, which they claim stifles creativity, promotes uniformity and treats musicians unfairly.

Last December, a lawyer for Clear Channel sent RadioAid a letter asking the company to stop using the domain name. RadioAid refused.

In May, Clear Channel filed a complaint with the National Arbitration Forum, the first stop in dealing with such disputes as required by the Internet Corporation for Assigned Names and Numbers.

Clear Channel won the case earlier this month, theoretically gaining control of the domain.

However, the lawsuit filed in federal court Tuesday prevents that transfer for the time being.

Clear Channel did not immediately respond to inquiries about the suit Tuesday.

However, in a letter to RadioAid founder Rob Vining and in its original complaint, Clear Channel argues that Clear ChannelSucks.net uses Clear Channel's name to divert consumers to its competition -- that is, a business that directly relates to broadcasting music.

RadioAid's lawyer, Pete Kennedy, said that RadioAid's business philosophy and mission are, in part, to criticize what the company sees as an overly commercialized and overly consolidated music industry.

"Whether they're right or wrong, they believe they have the right to make that criticism, and this domain name, they believe, is part of that critique," Kennedy said. "RadioAid.com believes it has First Amendment rights just like individuals."

Kennedy said that in similar cases across the nation -- and there have been many -- the courts typically favor the critics. RadioAid's case is different because most of the past "sucks.com" or "sucks.net" cases involved domain names owned by individuals or advocacy groups -- not other corporations.

Vining, who runs the company out of his South Austin home, said his site features about 500 artists worldwide who pay RadioAid for Web sites and music storage space.

The company's officers decided to purchase the ClearChannelSucks.net site because, in Vining's words, "We've always been upset about how radio was just becoming bland and boring."

Yet another day on the farm...

A day like every other. Its cloudy, I have a headache and I just got the mail. Speaking of the mail, what is the deal with our country? Here we are... A nation of millions, millions of which are constantly complaining about the worsening of our environment. As I sit here, I hold in my hand no less than 4 "ZERO PERCENT APR UNTIL NOVEMBER 2005" "invitations", two flyers and two different - ironically - environmental groups trying to solicit my donation. Hey, heres my donation Sierra Club - stop mailing me inch thick envelopes filled with paper that was, yup you guessed it, just recently a tree. Not to mention the nice glossy paper you are using that is literally clay that is spread onto the paper and then buffed. What is wrong with us? We hear day in and day out how horrible SUVs are, yet we simply accept junk mail as a given and toss it immediately into the trash. I literally threw out 8 things today. I kept ONE. Stacked, these 8 things rose about 6 inches high in my palm and all varied in length and width. Imagine if every person in america got this same mailing today?

Lets do some math, shall we? Accoring to the US Census there are 119,117,000 occupied homes in the USA. Lets assume that each one of them received 1/3rd the amount of mail I got today(about 2 inches). 119,117,000 x 2 = 238,234,000 inches of mail (in height only) was delivered today. 19.8 million FEET tall. 3760 MILES HIGH. Now, I am fully aware that my numbers are skewed. But does it matter if its 3000 miles? The scary part is I'm only basing this on household mail. We havent even touched upon the amount of mail going to businesses every day. Also, as an ex-mailman, I can tell you that there are people who receive a whole lot more than 2" of mail every day. Some people get FEET. Sure, some people get little to none, but all of this is besides the point.

Miles of mail being thrown out every day... I dunno about you, but this totally freaks me out. I realize that things like SUVs are literally a poison to our very existence. But trees help filter out that poison thus giving us some nice fresh air to breath while doing 75 down some residential street in our shiny new Hummer enroute to the dump to dispose of this weeks junk mail.

Have you seen my page regarding re-electing George W. Bush?

Here. I have decided, rather than waste my time spouting off into this text box, I would simply use(when available) everyday headline news as a source for reasons why we shouldn't be re-electing George W. Bush. I sometimes have to go off of My Yahoo homepage and hit up Alternet or The Nation, but for the most part, its just a daily link to an everyday news item.

Do me a favor this November, will ya? Don't vote for Bush. The "lesser of two evils" - Kerry - is exponentially less evil than W. My prediction, is that Kerry is just bad enough, that in the 2008 elections, we will probably see a third party putting a dent in our two party system. If not 2008, then definitely by 2012. Lets hope that Kerry turns out to be one hell of a leader. I unfortunately am a pessimist when it comes to American politics and just can't imagine that happening. My ray of hope is focused on 2008 and 2012... Years when I might be represented even 1% by my government. Until then, I'll be shooting people in Joint Operations - Typhoon Rising. Have I mentioned how much I like this game?

Well, things are picking up on the Radioaid front. I made a post here with a list of sites that came up with a google search of radioaid + clear. Not bad... Heres hoping the word maintains growth like this.

As for my day... Well, its a day like any other. Overslept yet still tired. Freakin out over something a friend and I are discussing on IM right now. BAH.

Joint Ops... BUY IT. I got asked to be on a clan "The Reckoning" so now my name is D3X-TR- and I play with teammates rather than 75 people who run around like chickens with their heads cut off. We use this app called teamspeak which allows us to talk while in "battle." If you havent bought the game yet, GO BUY IT. Let me know your username and we'll hook up and whupp some ass!

A call to action: Radioaid.com vs Clear Channel Communications

"ClearChannelSucks.net" and gave the website to the complaintant,
Clear Channel Communications."


And now they need our help.

Via a donation drive, Radioaid.com plans to file suit against media conglomerate Clear Channel Communications in an attempt to retain their first amendment rights. What Rob Vining is actually fighting for, is our first amendment rights. A win in court, would literally be a win for American freedom and democracy and our ability to maintain free speech.

I will have more on this as it develops, but for now, Radioaid has all the preliminary info you need and several ways for you to donate. Radioaid is offering platinum listener accounts to all that donate to the cause. You can read all about Radioaid on their website. In a nutshell, albeit a very small one, Rob is trying to put the control of media into the hands of the people. He has a very realistic vision of how to accomplish this, but as always, he cannot do this alone. He needs our help. If you can't donate to his cause, then at least tell one person about this or and ask them to do the same. At the very least, please put a link to www.Radioaid.com on your website.

As I'm sure you know, the beauty of the internet, is power through word of mouth. We can all do our part in this battle.
